Regulation 4 of the Control of Asbestos at Work Regulations 2002 created a new
obligation to manage asbestos in all non-domestic premises. This basically means
that all non-domestic premises have to checked for the presence of asbestos so
that any people carrying out building or maintenance works can be notified of
it and then are able to prepare properly for it.
This legislation was brought in because, according to the HSE, up to 500,000
industyrial and public buildings in the UK were suspected to contain asbestos
materials which could be harmful.
The legislation means that owners of non-domestic premises must have an asbestos
management plan in placeby 21st May 2004 - and then kept up to date if they are
aware of, or suspect that their buildings contain Asbestos Containing Materials.
